General criminal law

The criminal law generally determines the general principles of the offenses, the general conditions of the crime and the means of determining penalties. It sets out the principles of criminal liability, causes of irresponsibility and the cause aggravation or mitigation of punishment.

The fundamental principles of criminal law within constitutional law. Sections 34 and 37 set the criminal jurisdiction, the legislature is sole authority to determine the charges and the penalties for crimes while fines are the responsibility of regulatory power. Moreover the fundamental principles recognized by the laws of the Republic and solemnly reaffirmed in the preamble of the Constitution as part of the block whose constitutionality the Constitutional Council for its decision of July 16, 1971 is a basic control, these principles have constitutional.

Criminal responsibility

Requirement for a person to answer for its illegal acts on the basis of the criminal penalties provided by law. The basic principle of criminal responsibility is expressed in Article 121-1 of the Penal Code.  No one is criminally liable for his own conduct.

Criminal liability punishes a prohibited act (violation, misdemeanor or crime). If the offense resulted in more damage, the liability is incurred.

Criminal penalties (fines, …) are not insurable. However, defense costs can be covered: the legal protection.

Criminal responsibility for others

Obligation for a person to answer for the illegal acts of others in the criminal courts. Criminal responsibility for others is excluded by the French law on the principle of personality of sentences ( Article 121-1 of the French Penal Code “  No one is criminally liable for his own conduct . “)

Criminal liability of legal persons

“A corporation, other than the State, are criminally liable, according to the distinctions of articles 121-4 and 121-7 and as provided by law or regulation, for offenses committed on their behalf, by their agents or representatives. “ ( Article 121-2 of the French Penal Code)

Criminal liability of the entrepreneur

Liability under the labor code for various offenses including the business manager is responsible for its quality.Article L 263-2 and Article L. 263 -2 to 1( French code).
